Heath Leonard, 44, faces the charge of theft by deception, a class B felony according to documents filed in the Fulton County Clerk’s Office June 16.

According to the affidavit for probable cause of arrest, in January of this year, Cully Parr wrote two checks in the amount of $37,500 to Leonard for the construction of a 20’ by 50’ shop building to be constructed in Glencoe.

Since that time, the affidavit states in May, Parr spoke to Leonard telling him he was going to use another contractor and asked for the money back. Leonard told Parr he was going to be receiving checks from vendors for the refund and would be in the mail.

On June 9, an investigator with the Fulton County Sheriff’s Department called Leonard regarding the funds and were told it would be taken care of by June 14. On June 16, the date the affidavit was filed, funds had not yet been returned.

Bond for Leonard has been set at $10,000.
