A man is facing charges in Fulton County after showing up to visit his daughter intoxicated and attacking the child’s mother while demanding sex.
According to an affidavit for warrant of arrest filed Oct. 7, on Oct. 5, 40-year-old Randall Durbin traveled to a residence in Viola.
When he arrived, the victim told authorities Durbin appeared to have been drinking and became angry when she refused to have sex with him.
Durbin grabbed the victim by the throat throwing her on to a bed while telling her he would kill her. The incident was witnessed by an older child who threatened to call 911.
The victim was able to dial 911 for help, however; Durban took her phone and destroyed it before throwing it onto the roof of the home.
When deputies arrived, Durbin was sitting in his truck with the daughter he’d come to visit.
After deputies interviewed the victim, they attempted to speak to Durbin.
“Randall was not forthcoming with any information regarding the incident and do the injuries there were visible on the victim, deputies attempted to take Randall into custody,” the affidavit stated. “Randall resisted the officers, striking one of the officers with a glancing blow.”
An Electronic Control Device was used to subdue Durbin who was then taken into custody.
As a result, Durbin has been charged with battery in the second degree, a class D felony; terroristic threatening in the first degree, a class D felony; resisting arrest, endangering the welfare of a minor and interference with emergency communication.
Bond for Durbin was initially set at $25,000 but was reduced to $20,000 after an agreement was made with the prosecuting attorney.
