Fulton County authorities are seeking 52-year-old David Andrew Lange after a couple made report with the Cherokee Village Police Department, stating they had purchased property from a man who claimed his name was David Joas.
According to the affidavit in the case, on March 6, the victims contacted the Cherokee Village Police Department and stated they had been in contact with the Lange who had showed the two several pieces of property within the city limits of Cherokee Village on the Fulton County side.
Lange claimed he was in the process of purchasing the entire property from the city and that he could sell the victims the building site.
Lange stated he was in association with Yard Homes, a construction company which could build a home on the site and requested a down-payment of $58,000 which was wired to his account on Dec. 8, 2023.
The victims continued to communicate with Lange regarding the progress in building the home and were told the clearing of the lot was completed and the foundation was being poured the week of March 8 and then framing would take place.
After contacting the Planning and Zoning department, it was discovered the land was not owned nor had it been owned by the City of Cherokee Village as Lange had stated. The property covering approximately 11 acres had also never been sub divided nor had there been a request for subdividing the property and no permits had ever been requested or issued for the property.
The Fulton County Assessors Office was contacted and a copy of the deed for the property showed the owners to reside in Florida. After speaking with the property owners, authorities were told the property had not been subdivided and was in fact in the hands of a local Realtor.
The Realtor was contacted and showed a copy of the real estate contract which was completed on Jan. 5.
The purchaser was identified by the Realtor as David Lange doing business as Fonce Chevalier Holdings, LLC.
There was neither a security deposit nor escrow deposit made by Lange on the property.
As a result, a warrant for arrest has been issued for Lange. When apprehended he will face charges of theft of property, a class B felony and as a habitual offender. His bond will be set at $58,000.
