A Cherokee Village man who failed to perform work he had been hired to do has been charged in Fulton County, for the second time regarding the same issue.
According to the affidavit of arrest for 44-year-old Heath Leonard, in January of 2022, Cully Parr entered into a verbal contract for Leonard to build a large shed/workshop at his home in Glencoe.
The agreed amount for work and materials was $30,500 and Parr wrote two checks to Leonard for the construction.
Since that time, the only work performed was the marking of the building location “with string and stakes. No other work has been done on the shed.”
In May of 2022, Parr informed Leonard he would be using another contractor and requested his money be returned.
Leonard stated he would be receiving refund checks from vendors and they should be in the mail.
Parr was able to return some of the building material that was delivered to the site and received $4,707.74 for the materials.
As of Jan. 13 of this year, the remaining $25,792.26 have not been returned to Parr.
As a result, Leonard faces the charge of theft by deception in excess of $25,000, a class B felony.
Leonard was released on his own recognizance.
The initial charge against Leonard for the same case was filed June 16, 2022, however; on July 8, 2024 the prosecution filed a motion and order to decline prosecution. This was just two days before the case was set for trial.
The initial charge was Nolle Prossed and the case disposition Nolle Prosequi.
